These Terms of Service (“Terms”) govern your access to and use of crowdcapturemedia.com (the “Site”) and the services described on it, offered by Crowd Capture Media (“CCM,” “we,” “us,” or “our”), a digital marketing agency based in Temecula, California. By using the Site or submitting our lead form, you agree to these Terms. If you do not agree, please do not use the Site.
Who we are
Crowd Capture Media provides social media management, paid advertising (Google, Meta, and related platforms), and Google Business Profile optimization for local businesses, primarily serving Temecula, Murrieta, San Diego, Menifee, and Orange County, California.
Use of the Site
You may use the Site for lawful purposes only. You agree not to: (a) use the Site in any way that violates applicable law; (b) attempt to gain unauthorized access to any part of the Site or our systems; (c) scrape, copy, or reproduce Site content for commercial use without our written permission; or (d) interfere with the proper functioning of the Site.
Services & client engagements
Descriptions of services on the Site are for general informational purposes and do not constitute a binding offer. Pricing is not published on the Site and is provided directly during a consultation. Any paid engagement is governed by a separate agreement or invoice between Crowd Capture Media and the client, which sets out the specific scope, monthly rate, term, and deliverables for that engagement. Where these Terms conflict with a signed client agreement, the signed agreement controls.
No guarantee of marketing results
Digital marketing, advertising, and Google Business Profile outcomes (including rankings, reach, leads, conversions, and revenue) depend on many factors outside our control, including platform algorithm changes, market competition, ad spend, and client-provided information. We do not guarantee specific rankings, traffic, lead volume, or revenue results from any service referenced on the Site.
Intellectual property
All Site content — including text, graphics, logos, photography, videography, and design — is owned by Crowd Capture Media or used with permission (including client work samples shown on our Work page) and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent. Ownership of client-specific final deliverables transfers upon full payment as specified in the applicable client agreement.
Third-party links & services
The Site may link to or rely on third-party services (such as Google, Cloudflare, Resend, and Klaviyo) that are governed by their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party sites or services.
Disclaimer of warranties
The Site and its content are provided “as is” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
Limitation of liability
To the fullest extent permitted by law, Crowd Capture Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Site. For paid client engagements, our total liability is limited as set out in the applicable signed client agreement.
Indemnification
You agree to indemnify and hold harmless Crowd Capture Media and its founder and employees from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site shall be resolved in the state or federal courts located in Riverside County, California.
Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised “Last updated” date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
